Terms of Service

By accessing thynkq.com or engaging ThynkQ for services, you agree to these Terms of Service. ThynkQ is a senior engineering studio operated by Abanoub Rodolf Boctor, based in New York, NY. ThynkQ is not a separately incorporated entity. Agreements are currently signed personally. If your procurement process requires a registered counterparty, raise it during scoping. Entity formation can be completed before contract signature.

These terms govern use of the thynkq.com website. Custom development engagements are additionally governed by a separate project agreement or Statement of Work (SOW), which takes precedence over these terms where there is a conflict.

ThynkQ provides custom software engineering services including fixed-scope product builds, AI integration, technical audits, engineering retainers, and technical consulting. Engagement lanes, their fixed prices, and any gating are published on the pricing page. Some lanes are not self-serve: the Engineering Retainer ($12,000 / month, billed monthly, 3-month initial minimum, then cancellable with 14 days' notice, no refunds for the current billing period) opens only after a completed ThynkQ build or a warm referral.

Scope and deliverables for larger custom engagements are defined in a signed project agreement.

Payment processor: All payments are processed by Stripe, Inc. By completing a purchase, you also agree to Stripe's terms of service. ThynkQ does not store your payment card details.

Fit calls: Fit calls are free. If you need to cancel or reschedule, do so via the booking link.

Custom engagements: For custom development work, payment terms are defined in the project agreement. Standard published terms are 50/50 on everything up to $59,999. Three milestones (40/30/30) on $60,000+ engagements. The deposit is fully refundable if you cancel before kickoff begins, and non-refundable once kickoff begins. No work starts before the deposit clears. Invoices unpaid after 30 days may accrue interest at 1.5% per month.

All content on thynkq.com, including text, code, designs, and graphics, is owned by ThynkQ unless otherwise attributed. You may not reproduce, distribute, or create derivative works without explicit written permission.

For custom development engagements, intellectual property rights (including code ownership) are specified in the signed project agreement. The standard arrangement is that all custom code transfers to the client upon receipt of full payment.

We treat all client project details, codebases, and business information as confidential. We do not share details of your engagement with third parties without your explicit written consent. We are happy to sign a mutual NDA before any project discussion begins.

ThynkQ provides services and products "as is" without warranties of any kind, express or implied, including warranties of fitness for a particular purpose or uninterrupted operation.

Our total liability in connection with any service or product is limited to the fees you paid for that specific engagement or product. We are not liable for indirect, incidental, consequential, or punitive damages.

You may not use ThynkQ services to build anything that is illegal, fraudulent, deceptive, or designed to cause harm to others. This includes but is not limited to: spam tools, surveillance software without consent, content that violates applicable law, or anything that infringes the rights of third parties.

We reserve the right to decline or terminate any engagement at our discretion if this policy is violated, with a pro-rated refund for services not yet rendered.

These terms are governed by the laws of the State of New York, United States, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in New York County, New York.

We may update these terms from time to time. We will update the "Last updated" date at the top of this page. For active client engagements, the terms in your signed project agreement take precedence and will not change retroactively.
