Terms of Service

Agreement
By accessing thynkq.com or engaging ThynkQ for services, you agree to these Terms of Service. ThynkQ is operated by Abanoub Rodolf Boctor, an AI engineering company based in New York, NY.
These terms govern use of the thynkq.com website and digital product purchases. Custom development engagements are additionally governed by a separate project agreement or Statement of Work (SOW), which takes precedence over these terms where there is a conflict.
Services
ThynkQ provides custom software engineering services including MVP development, AI integration, fractional CTO advisory, and technical consulting. Service tiers available through this website include:
- Strategy Call ($200 / 30 min) — A focused session to assess your technical situation and define a path forward.
- Deep Dive ($350 / 60 min) — Extended technical consultation covering architecture, team structure, or AI implementation.
- Fractional CTO ($10,000–$15,000 / month) — Ongoing fractional CTO engagement. Billed monthly. Either party may cancel with 14 days' notice. No refunds for the current billing period.
Scope and deliverables for larger custom engagements are defined in a signed project agreement.
Digital Products
ThynkQ sells digital products (templates, guides, and starter kits) through this website. Payments are processed by Stripe. By purchasing a digital product, you receive a non-exclusive, non-transferable license to use it for personal and commercial projects.
- Restrictions — You may not resell, redistribute, sublicense, or publicly share the product files without written permission from ThynkQ.
- Refunds — All digital product sales are final. Because products are delivered immediately upon purchase, we do not offer refunds. If you experience a technical defect (broken files, access failure), contact rodolf@thynkq.com within 7 days and we will resolve it.
- Updates — Products include updates within the same major version. Major version releases may require a new purchase.
Payment and Billing
Payment processor — All payments are processed by Stripe, Inc. By completing a purchase, you also agree to Stripe's terms of service. ThynkQ does not store your payment card details.
Consultation sessions — Strategy Call and Deep Dive sessions are paid in full at the time of booking. If you need to cancel or reschedule, do so at least 24 hours before the scheduled time via the Cal.com booking link. Cancellations with less than 24 hours' notice are non-refundable.
Retained Advisory — Billed monthly via Stripe subscription. You may cancel at any time and your access continues until the end of the current billing period. We do not provide refunds for partial months.
Custom engagements — For custom development work, payment terms are defined in the project agreement. Standard terms are 50% upfront and 50% on delivery, unless otherwise agreed in writing. Invoices unpaid after 30 days may accrue interest at 1.5% per month.
Intellectual Property
All content on thynkq.com — including text, code, designs, and graphics — is owned by ThynkQ unless otherwise attributed. You may not reproduce, distribute, or create derivative works without explicit written permission.
For custom development engagements, intellectual property rights (including code ownership) are specified in the signed project agreement. The standard arrangement is that all custom code transfers to the client upon receipt of full payment.
Confidentiality
We treat all client project details, codebases, and business information as confidential. We do not share details of your engagement with third parties without your explicit written consent. We are happy to sign a mutual NDA before any project discussion begins.
Limitation of Liability
ThynkQ provides services and products "as is" without warranties of any kind, express or implied, including warranties of fitness for a particular purpose or uninterrupted operation.
Our total liability in connection with any service or product is limited to the fees you paid for that specific engagement or product. We are not liable for indirect, incidental, consequential, or punitive damages.
Acceptable Use
You may not use ThynkQ services or digital products to build anything that is illegal, fraudulent, deceptive, or designed to cause harm to others. This includes but is not limited to: spam tools, surveillance software without consent, content that violates applicable law, or anything that infringes the rights of third parties.
We reserve the right to decline or terminate any engagement at our discretion if this policy is violated, with a pro-rated refund for services not yet rendered.
Governing Law
These terms are governed by the laws of the State of New York, United States, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in New York County, New York.
Changes to These Terms
We may update these terms from time to time. We will update the "Last updated" date at the top of this page. For active client engagements, the terms in your signed project agreement take precedence and will not change retroactively.
